 • SCOPE, AGE & APPLICATION
These Terms and Conditions (hereinafter referred to as the "Terms") shall apply to the use of the website www.vitapatch.co (hereinafter referred to as the "Website") and all purchases of products, including without limitation, transdermal patches (hereinafter referred to as the "Products"), which are sold through this Website by Vita Patch LLC (hereinafter referred to as "we," "us," or "our") to you (hereinafter referred to as the "Customer"). All Customers under the age of 18 must obtain prior permission from a parent or legal guardian to purchase Products from the Website. By accessing the Website or making any purchase, you confirm that you are at least 18 years old or have obtained such permission. If you do not agree to abide by these Terms, you are advised to immediately leave the site and discontinue any use of the Products.

 • OFFER, ACKNOWLEDGEMENT & ACCEPTANCE
Any prices, quotations, and descriptions made or referred to on this Website are subject to availability, do not constitute an offer, and may be withdrawn or revised at any time prior to our express acceptance of your order. While we make every effort to ensure that Products displayed on the Website are available, we cannot guarantee that Products will always be in stock or available when you place your order. We reserve the right to reject your order for any reason without explanation. In such cases, any prior payment made for the Product will be refunded in full. An order submitted by you constitutes an offer to us to purchase Products on these Terms and is subject to our acceptance. Our acceptance of your order takes effect when we dispatch your order and accept your payment (hereinafter referred to as "Acceptance"). Prior to such acceptance, any automatic order confirmation sent to you does not constitute a formal acceptance of your order.

 • INTELLECTUAL PROPERTY RIGHTS
All intellectual property rights related to VITA, including but not limited to the brand name, logo, product designs, packaging, marketing materials, website content, formulations, and any proprietary information (collectively referred to as the "Intellectual Property"), are the exclusive property of VITA Patch LLC or its licensors. This Intellectual Property is protected by copyright, trademark, and other intellectual property laws in Canada, the United States and the European Union. No portion of the Intellectual Property, including any transdermal patch formulations, branding, or marketing materials, may be reproduced, distributed, publicly displayed, transmitted, modified, or used in any form or by any means without prior written permission from VITA Patch LLC. Any unauthorized use, reproduction, or distribution of such materials will result in legal action, including claims for damages. This protection extends to all products, digital media, marketing content, packaging designs, and any other creations associated with VITA. Unauthorized use of our Intellectual Property, including counterfeiting or imitation of the product or brand identity, will be pursued to the fullest extent of the law. By purchasing or using any VITA products, you agree not to infringe, copy, or misappropriate any aspect of VITA's Intellectual Property, including attempts to register, claim ownership, or replicate any of the proprietary formulations or brand assets

 • DELIVERY, SHIPPING & RISK
At this time, Vita Patch LLC ships to all countries except those restricted due to local regulations or logistical limitations (hereinafter referred to as the "Territory"). Delivery times may vary depending on the destination country, but all orders are generally shipped (subject to availability) within 1-3 business days. During high-demand periods, such as new product releases, delivery times may be delayed, and Vita Patch LLC shall not be held liable for such delays. Shipping and delivery times provided are estimates only. While we endeavor to meet these estimates, we do not guarantee delivery by a specific date and shall not be liable for any delays or failure to meet such timelines. Delivery will be made to a valid address provided by you (hereinafter referred to as the "Delivery Address"). It is your responsibility to ensure that the Delivery Address provided during checkout is accurate. Any changes made to the Delivery Address after your order is placed may incur additional charges. All orders are shipped using standard shipping carriers. Vita Patch LLC offers flat-rate shipping options within certain regions, which shall be paid by the Customer. Other shipping fees will vary by region. The risk of loss or damage to the Products passes to you upon delivery to the carrier or when placed in your possession or that of a third party responsible for delivery, whichever occurs first (hereinafter referred to as "Delivery").

 • LIABILITY
Vita Patch LLC shall not be liable for any damages resulting from the use of this Website or Products purchased through it, including but not limited to loss of income, business interruptions, loss of data, operational failures, or similar losses. Any claims for damages against us, including without limitation, punitive, indirect, special, incidental, or consequential damages, and any claims raised under the rules on product liability, shall be limited to the amount paid by you for the Product in question, irrespective of the nature of the claim, whether in contract, tort, warranty, or otherwise. Vita Patch LLC shall not be held liable for any content or material linked to third-party websites, nor does it assume responsibility for the content on any third-party websites linked from this Website.

 

 • COPYRIGHT & TRADEMARKS
All Products, as well as all content and infrastructure of the Website, including but not limited to graphics, logos, text, images, audio files, videos, and other materials, are the property of Vita Patch LLC and are protected by copyright, trademark, and other intellectual property rights. Images on this Website are incorporated for viewing purposes only and may not be saved, downloaded, reproduced, distributed, publicly displayed, or otherwise used in any format without prior written consent from Vita Patch LLC. Unauthorized reproduction, distribution, or public display of any of our Products, trademarks, or any intellectual property belonging to Vita Patch LLC may result in civil and/or criminal sanctions, including but not limited to liability for damages.

• RETURN POLICY
Vita Patch LLC accepts returns of Products in perfect, unopened, and unused condition. For the avoidance of doubt, Products may not be returned if they have been opened or used. All returns must be shipped back within 60 days of Delivery. Returned items must be shipped using a carrier that provides tracking information, and proof of delivery to Vita Patch LLC must be provided before any refunds will be issued. The Customer is responsible for covering the costs related to returning the Products. Refunds are issued no later than 7 business days after the returned items have been received and inspected by Vita Patch LLC to ensure they meet the return policy conditions.

 • PURCHASE FOR PERSONAL USE ONLY
You may purchase Products from Vita Patch LLC solely for personal use and
not for resale. By placing an order on the Website, you certify that you are purchasing Products for personal use only and not for any form of resale or distribution. We reserve the right to refuse or cancel any order if we suspect that the Products are being purchased for resale. In such cases, any payments made for the Products will be refunded, and the order will not be fulfilled.

 • PAYMENT, CUSTOM DUTIES & EXPORT VAT
Vita Patch LLC currently accepts the following forms of payment: Visa, Mastercard, American Express, PayPal, Apple Pay, Shop Pay. Please note that for those countries outside of the Canada, you may be liable to pay your country’s VAT, as well as any relevant import duties. Vita Patch LLC assumes no responsibility for any additional taxes, customs duties, or fees that may apply to your order, nor for any delays caused by customs processing. If a package is held in customs due to unpaid fees, it is the Customer’s responsibility to settle these charges for the package to be released.
